Judges’ Roundtable

Attendees heard from a plethora of European judges on how their courts are approaching case management and quantification of damages.

DMA, DSA & Digital Markets

A discussion on the scope of private enforcement under the DMA, DSA and other digital markets regulations. Will there be divergence between the EU and the UK? And, what does Germany’s 11th Amendment to the Competition Act mean in this area of competition law? 

Article 102

A review of the current Article 102 cases including Google Shopping, Heureka v Google, Apple, as well as private enforcement in the pharma sector. Then, a focus on standalone abuse of dominance cases and how economic perspectives in this area differ from more traditional cartel cases. 

Collective Actions & Claims Bundling

How should claims be bundled? What is the best way to get carriage disputes certified in the UK? What lessons can be be learnt from Meta, RoRo and RHA? And, how do we best manage such large cases, often in parallel and even conflicting jurisdictions? 

Jurisdiction Revisited

What jurisdiction do the EU Courts have? And, is EU law applicable to claims brought by non-EU claimants for conduct outside the EU? Followed by an examination on the impact of Brexit on the UK as a premier private enforcement forum in Europe. 

Quantification of Damages & Disclosure

Another review on approaches to disclosure by the courts in the UK, Germany and Netherlands, including whether a court can freely estimate or if there's a need for previous disclosure. What is reasonable? What conditions are required for estimation? Then, an analysis on the role of economists within disclosure.
