Main duties

ESMA is organising a selection procedure for the post of Legal Officer within the Legal and Enforcement Dept. to fill a post in the Enforcement Team.

The jobholder will be assigned to one or several of the below areas under the supervision of the Enforcement team leader.

The jobholder will be providing to the Management and the other departments of ESMA sound outcome-focussed legal analysis and advice in the remit of the team, as well as participating in investigations as described above:

  • Conducting legal research and analysis of case-law, in particular from the European Court of Justice, in matters related to ESMA’s exercise of direct supervisory powers and enforcement action, as well as to ESMA’s breach of Union law powers or on questions relating to professional secrecy matters;
  • Encrypting, preparing and monitoring access to investigation files in the context of enforcement proceedings;
  • Contributing to supervisory convergence efforts, in particular through coordinating the work of the Enforcement Network or handling complaints against National Competent Authorities;
  • Contributing to legal proceedings notably before the Board of Appeal and the Court of Justice of the European Union, in liaison with the Legal Unit.

Professional qualifications and other requirements

Eligibility criteria

To be considered eligible, candidates must satisfy all the eligibility criteria listed below:

  • have at least a level of education which corresponds to completed university studies of three years attested by a diploma and after having obtained the diploma, one year of proven professional experience;
  • be a national of a Member State of the European Union or the EEA (Norway, Liechtenstein, Iceland);
  • enjoy full rights as a citizen;
  • have fulfilled any obligations imposed by the applicable laws concerning military service;
  • have a thorough knowledge of one of the languages of the European Union and a satisfactory knowledge of another language of the European Union; and
  • be physically fit to perform the duties linked to the post.

Selection criteria

Essential requirements

  • The university diploma (required under part A) must have been acquired in law;
  • At least one (1) year of professional experience in a legal function, undertaken in a law firm, an (EU or national) administration or in a company’s legal team;
  • Knowledge, as evidenced by education and/or professional experience of financial services law; and
  • Excellent written and oral English.

Advantageous requirements

  • Experience with enforcement or litigation matters;
  • Experience with legal research databases, web-scrapping tools, or encryption software or other legal IT tools;
  • Experience in drafting legal advice or legal reports,
  • Knowledge of or experience with EU institutional law, data protection rules or ethics issues;
  • Experience with/in international organisations, national authorities or EU institutions, ideally in the context of the financial sector;
  • Motivation for the advertised position.

Supplementary requirements

  • Very good organisation and prioritization skills and ability to handle large volume of work in an efficient and timely manner;
  • Good communication skills and ability to deliver clear messages and articulate concerns;
  • Proactive person with strong aptitude for teamwork.
